Who Is At Fault for a Rear-End Accident in Florida?

In almost all scenarios, the driver that strikes the car in front of them is determined to be at fault for an accident.

Two exceptions include:

  • A driver’s vehicle’s wiring was faulty and their brake lights did not work
  • A multi-vehicle or “chain reaction” accident where one vehicle pushes a vehicle into another vehicle.

As a driver, you have the responsibility to not follow so closely that they cannot avoid striking the car in front of it. Rear-end accidents sometimes involve multiple vehicles, when a car or truck pushes a second car into a third vehicle. In this situation, the driver that first struck the second vehicle would also be responsible for the collision into a third vehicle.

When you first started driving, you probably heard about the “three-second rule” which was a rule of thumb to give yourself adequate spacing. Florida’s Driver Handbook (Pg. 51) recommends that you keep at least four seconds following distance,  and also increase following distance during heavy traffic or unfavorable weather or heavy traffic.

The guidance states that you should see a vehicle pass a fixed point, such as a sign or bridge, and if you count out the seconds (“one thousand and one, one thousand and two…”) that it takes you to reach the same location in the road, that should allow you to determine if you are far enough behind the car in front of you.

Common Types of Rear-End Accident Injuries

Even accidents occurring at slow speeds can cause serious damage. Rear-end accidents can cause all types of injuries:

Whiplash, technically a cervical strain, is the most common type of injury resulting from a car crash when the head is violently thrown forward and then backward. Whiplash is a type of “soft-tissue” injury. The skin is not broken, and bones are not broken, and there may be no swelling or visible bruising.

Insurance companies love to downplay this injury and offer car accident victims minimum compensation.
