Who Is At Fault for a Rear-End Accident in Florida? 

In almost all scenarios, the driver that strikes the car in front of them is determined to be at fault for an accident.

Florida’s Driver Handbook (Pg. 51) recommends that you keep at least four seconds following distance,  and also increase following distance during heavy traffic or unfavorable weather or heavy traffic.

The guidance states that you should see a vehicle pass a fixed point, such as a sign or bridge, and if you count out the seconds (“one thousand and one, one thousand and two…”) that it takes you to reach the same location in the road, that should allow you to determine if you are far enough behind the car in front of you.
